1. Agreement to Terms

By downloading, installing, or using the Calm Urge application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Shining Muffin LLC ("we," "us," or "our").

2. Description of Service

Calm Urge is a mental wellness mobile application that provides therapeutic activities, mood tracking, journaling, and daily support tools to help users manage difficult emotions. The Service includes:

• 12 therapeutic activities (breathing exercises, fidget tools, art activities, meditation, and more)
• Daily mood and feelings tracking
• Daily pledge and intention setting
• Journal and writing features
• Motivational messages
• Emergency contact access
• Optional cloud sync across devices

3. Health & Safety Disclaimer

Calm Urge is not a medical device, therapy service, or substitute for professional mental health care. The app does not provide medical advice, diagnosis, or treatment of any kind.

The therapeutic activities and tools provided by the Service are intended for general wellness purposes only. They are not designed to treat, cure, or prevent any medical or psychological condition.

You acknowledge that your use of the Service is at your own risk and that you should not rely on the app as a substitute for professional guidance.

4. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian.

By using the Service, you represent that you meet these eligibility requirements.

5. User Accounts & Content

You may optionally create an account using Google Sign-In to enable data syncing across devices. You are responsible for maintaining the security of your account credentials.

You retain ownership of any content you create within the app, including journal entries, mood data, and pledges ("User Content"). By using the Service with cloud sync enabled, you grant us a limited, non-exclusive license to store and transmit your User Content solely for the purpose of providing the Service to you.

We do not access, review, or share your User Content except as necessary to provide the Service or as required by law.

6. Subscriptions & Purchases

Calm Urge offers optional premium features through in-app subscriptions. By subscribing, you agree to the following:

• Auto-renewal — subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date
• Payment — all payments are processed through the Apple App Store or Google Play Store
• Cancellation — you can cancel your subscription at any time through your device's App Store or Google Play subscription settings
• Refunds — refund requests must be directed to Apple or Google, as they handle all payment processing. We do not process refunds directly

Prices may vary by region and are subject to change. Any price changes will apply to the next billing cycle after the change is announced.

7. Intellectual Property

The Calm Urge app, including its design, code, graphics, animations, sounds, text content, and all other materials (collectively, "App Content"), is owned by Shining Muffin LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app
• Copy, modify, distribute, sell, or lease any part of the Service or its content
• Use the Service for any illegal, harmful, or unauthorized purpose
• Attempt to gain unauthorized access to the Service's systems or other users' data
• Use automated systems (bots, scrapers) to access the Service
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices

9. Limitation of Liability

To the maximum extent permitted by applicable law, Shining Muffin LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:

• Any health-related outcomes from using or relying on the app
• Loss of data, revenue, or profits
• Service interruptions or errors
• Any actions taken based on content within the app

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to us for the Service in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. The app's therapeutic activities are not medical advice, and we make no claims regarding their effectiveness for any specific condition.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction within the United States.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

For significant changes, we may provide additional notice through the app or by other means.
